These Terms of Use (“Terms”) apply to Cümbüş (the “App”), developed and published by Busra Hekimoglu, an independent developer publishing as NoxTri (“we”, “us”). By downloading or playing the App you agree to these Terms. If you do not agree, please do not use the App.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to play the App for your own non-commercial entertainment. Because you get the App from the Apple App Store, Apple’s Licensed Application End User License Agreement (Standard EULA) also applies; these Terms add to it.
2. The games and their content
The words, cards and song lists in the App were written for it and are in Turkish for now; the interface is in English and Turkish. Say It Backwards shows only a song’s title and artist: it contains no lyrics, audio or artwork, and players hum the songs themselves. Song titles and artist names belong to their owners and are used only to name the song to hum.
3. Family mode and content level
Family mode is on by default and shows only content that suits everyone. More grown-up content (the “General” and “Adult” levels) is kept separate and starts switched off; raising the level asks for the device’s passcode or Face ID. Choosing a level that suits everyone at the table is up to the device owner.
4. Your own categories
Categories you write yourself are stored only on your device; we receive no copy, and they are not shared with anyone. You are responsible for what you write in them; do not use them for content that is unlawful or meant to hurt the people you play with.
5. Free play and the Cümbüş Full Pack
All three games are free with no round limits: 6 categories in each game, 1 category of your own, a scoreboard and badges. The optional “Cümbüş Full Pack” unlocks 28 more categories and unlimited categories of your own. The Full Pack is a one-time purchase (non-consumable): there is no subscription and nothing renews. The App Store shows its price before you buy. The Full Pack belongs to the Apple Account that bought it and can be shared with Family Sharing. To get it back after reinstalling or on a new device, use Settings → Restore purchase, or the same button on the Full Pack screen.
6. Payment and refunds
Apple processes the purchase through the App Store under its terms. We cannot issue refunds ourselves: request a refund from Apple at reportaproblem.apple.com. If Apple refunds a purchase, the Full Pack categories may lock again; the free games and your scores stay as they are.
7. Your data
Player names, scores, badges, your own categories and your settings are stored only on your device; there is no cloud sync. They are lost if you delete the App or change devices, and we cannot restore them. The Full Pack itself can be restored from the App Store.
8. Acceptable use
You agree not to copy, modify, reverse engineer, redistribute or resell the App or its content, except as allowed by law, and not to use the App in any unlawful way.
9. Intellectual property
The App, including its design, word and card lists, text, graphics and code, is owned by us and protected by intellectual property laws. These Terms do not transfer any ownership to you.
10. Disclaimer
The App and its content are provided “as is” and “as available”, without warranties of any kind, to the extent permitted by law. We do not guarantee that it will be error-free, always available, or that every piece of content suits every table.
11. Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental or consequential damages arising from your use of the App, including lost scores. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
12. Changes
We may update these Terms. The “Last updated” date above shows the current version. Continuing to play after a change means you accept the updated Terms.
